Custom Made Finger and Thumb Splints

Definitions“Conditions”means these terms and conditions;“Contract”means the contract incorporating these Conditions which is formed when You place an Order and We confirm acceptance of such Order;“Order”means an order placed by You via email or the Facebook Page for one or more Products;“Personal Information”means all and any information provided by You in an Order or when registering on any part of this Website to include without limit your name, address and card details;“We/Us/Our”means Ring splints By Zomile“You/Your”means a user of this Website. The terms and conditions apply to the purchase of Products offered for sale through this Website and the equivalent terms and conditions for sale through Ring splints by Zomile via email, Etsy and the Facebook page.  QueriesContact Us if You have any questions relating to these Conditions or ordering the Products generally by using the contact us email. Description and AvailabilityWe take all reasonable measures to ensure that details, measurements and descriptions of Products given on this Website are as accurate and complete as possible but there may be variations between these and the Products themselves All Products are subject to availability. PricePrices appearing on this Website are inclusive.The cost of your Order will be the price of the Products ordered plus the appropriate delivery charge outlined in the “Delivery ” section. Prices on this Website may vary from time to time due to fluctuations in Gold and Silver prices. Prices are confirmed at time of ordering. Placing an order-All orders are subject to being accepted by Us and are subject to availability, approximate guide times will be advised when making an email query. Items not available or custom made items will take around 7-14 days. 9ct Gold splints will take 4-6 weeks.Orders are processed through Pay Pal and the Etsy store. An invoice will be generated at the time of ordering.On completion of payment an email will be sent to YOU.Orders are processed and delivered within approx. 7-14 working days (unless otherwise specified). Gold and larger orders will be sent special Delivey and may exceed the delivery guide time. Thumb Braces outside U.K will be sent International Track & Signed- International orders have a No Returns Policy, this excludes damage claims due to Postal damages which will go through the Mail providers claims process.Silver splint exchanges are subject to the terms and conditions set out, returned unworn and undamaged. For health and safety reasons splints are non refundable unless arranged by US in advance.Any Alterations due to error in measuring will incur a small fee for alterations which will be discussed prior to You returning your splint/s.Prior to ordering you are required to send your requirements and image of your measurement . Correct fit is the responsibility of the customer.A non-refundable  50% deposit will be taken when ordering 9ct Gold ring splints.Gold ring splints will only be made once a Silver splint has been dispatched to confirm your sizing. On completion of the splint the remainder 50% will be invoiced. Rings will be sent special delivery next day. *see delivery charges"It is the responsibility of the customer to ensure when paying that the correct address is displayed on PayPal/Etsy, this is the address where rings will be sent.Orders for UK & Ireland will be sent Royal Mail 1st class recorded post. Larger orders will be sent special delivery. International Orders for Interlock rings & Thumb splints - International Tracked and Signed. You may cancel a Contract and obtain a refund any time within 14 days after receipt of Products by notifying Us in writing and returning the Products to Us (See “Returning Products” below.) Rings must be returned unworn and undamaged.Return costs are the responsibility of the customer. 1 st exchange postage fee will be paid by US.Alterations will incur costs for resize due to mistakes in measuring.  Payment Methods:PAY PAL, NHS, Charities  & ACCESS TO WORK- bank transfer account via Invoicing. Lost Parcels - We will begin Our missing parcels procedure if your Order fails to arrive within 30 days (UK only) and 30 days (Ireland & International) of despatch and You notify Us in writing. We will investigate your claim and if We are satisfied that the non arrival of the Product(s) was attributable to Us or Royal Mail then a replacement item will be sent out.Parcels sent as returns to US are the responsibility of the customer. The customer is responsible for the charges incurred for returning items.Items returned due to incorrect sizing are the responsibility of the customer, as a result additional shipping charges may be incurred. Covid19 Update. Returns will be quarantined prior to adjustments being carried out, as a result lead times for exchanges will vary. We take your health and safety seriously, as a result we have put additional cleaning protocols in to place. *As a result of the  Covid19 pandemic ring splints can not be returned for a refund from January 1st  2021. Adjustments will be accepted Only after the returned products have been quarantined by US.  Returning for detailed instructions on returning items for adjustment.Ring splints should be purchased under the advice of a medical practitioner.Ring sizing/measuring is the responsibility of the customer/practitioner. Personal InformationPersonal information will be held via PAY PAL, ETSY no personal information will be shared with third parties.“Product”means any product advertised on this Website;“UK”means England, Scotland, Wales, Northern Ireland and Isle of Man'International'means any other Country outside the U.KClosure DatesDuring closure dates no orders will be processed. Events Outside Our ControlWe will not be liable or responsible for any failure to perform, or delay in performance of, any of Our obligations under this Contract that is caused by events outside Our reasonable control (“Force Majeure Event”). A Force Majeure Event includes any act, event, non-happening, omission or accident beyond Our reasonable control and includes, in particular (without limitation) the following:- a) strikes, lock-outs or other industrial action;b) Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war;c) Fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster;d) Impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport;e) Impossibility of the use of public or private telecommunications networks;f) The acts, decrees, legislation, regulations or restrictions of any government.Our performance under the Contract is deemed to be suspended for the period that the Force Majeure Event continues, and We will have an extension of time for performance during that period. We will use our reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which Our obligations under the Contract may be performed despite the Force Majeure Event.COVID 19 UPDATEDuring this time Delivery May be delayed. Please allow up to 21 days.
